What is construction adjudication?

Compared to construction arbitration and litigation, adjudication is a swift and cost-effective method of resolving construction disputes.

It aims to achieve a quick, sometimes temporary, settlement so that projects can continue without delay. Generally, the adjudicator (a neutral third party) will decide the dispute within 28 days of receiving the referral.
Adjudication can be used by parties to a “construction contract”, whether it contains explicit adjudication provisions or not. “Construction contract” has a wide definition in the Construction Act and can extend to verbal agreements.

What disputes can be referred to adjudication?

The construction adjudication process is used extensively for resolving various types of construction disputes, including:

Please note, all disputes under NEC3 and NEC4 contracts should be dealt with by way of adjudication in the first instance.
